PZS resolves issue of Dom v Tamarju

The day before yesterday, the Alpine Association of Slovenia resolved the issue of Dom v Tamarju, for which the denationalization procedure has been ongoing since 1992. Dom v Tamarju will remain a mountain hut for at least another 10 years even after signing the settlement on the regulation of legal relations, and all the same discounts for overnight stays apply in the hut for mountaineers and other cadres as in all mountain huts according to the records of the Alpine Association of Slovenia. The co-signatories of the settlement are Planinsko društvo Medvode, which has managed Dom v Tamarju until now, and Agrarna skupnost Rateče Planica, under whose auspices the hut has now passed.
The denationalization procedure for the return of Dom v Tamarju (1108 m) in the Tamar valley has been ongoing since 1992. According to our knowledge, the mountaineering organization, the Alpine Association of Slovenia (PZS), and Planinsko društvo (PD) Medvode were never owners of the hut; PD Medvode has only managed the hut since 1965. The mountaineering organization has utilized all legal means available to regulate this issue, ultimately PZS filed a request for revision with the Supreme Court of RS in 2012, which was rejected. The issue of Dom v Tamarju was addressed three times by the PZS Management Board in the last two years and approved the settlement proposal at its 15th session on 4.4.2013. The PD Medvode Management Board, as the hut's manager, also agreed to the settlement and the transfer of the hut into the possession of Agrarna skupnost Rateče Planica.
The tripartite settlement on the regulation of legal relations was signed yesterday, April 25, 2013, in Rateče by the Alpine Association of Slovenia, represented by PZS President Bojan Rotovnik, Agrarna skupnost Rateče Planica, represented by President Jožef Brudar, and Planinsko društvo Medvode, represented by President Franc Branko Stropnik.
With the settlement, Agrarna skupnost (AS) Rateče Planica also committed to maintaining the status of the mountain hut Dom v Tamarju for at least 10 years from the conclusion of this settlement. AS Rateče Planica undertakes to respect the manner of operation of the mountain hut, especially with regard to prices and discounts for overnight stays for members of mountaineering associations in RS, members of mountaineering associations in the borderlands, as well as members of mountaineering associations with which PZS has a Reciprocity Agreement, and benefits enjoyed by members of the mountain rescue service and PZS path markers who are on duty in the mountain huts. In this regard, AS Rateče Planica will comply with the PZS Rules on the management, operation, and equipment of mountain huts.

President of the Alpine Association of Slovenia Bojan Rotovnik said upon signing the settlement and handing over Dom v Tamarju to Agrarna skupnost Rateče Planica: "With the signing of the settlement, the legal procedure has ended after almost 22 years, in which the mountaineering organization unfortunately unsuccessfully tried to achieve that Dom v Tamarju would not be returned in kind to the denationalization beneficiaries. Unfortunately, the competent state authorities did not agree with the arguments presented by the mountaineering organization. Therefore, we have handed over the building and the associated land to Agrarna skupnost Rateče Planica, where they have provided strong assurances that the facility will continue to serve the purposes of mountaineering in the future. We thank Planinsko društvo Medvode for the exemplary management of Dom v Tamarju to date."
Jožef Brudar, President of AS Rateče Planica, emphasized that the management board of AS Rateče Planica unanimously approved that Dom v Tamarju will continue to maintain its status as a mountaineering facility. With the transfer of the hut to AS, nothing will change for mountaineers.

Dom v Tamarju (1108 m) stands on a beautiful alpine meadow in the upper end of the Planica valley, called Tamar. The first hut or small shelter (at a different location in Tamar) was built by the Radovljica branch of SPD and opened on September 3, 1899. Dom v Tamarju at this location has stood since 1936, when the Rateče-Planica branch of SPD purchased the pastoral-alpine hut Tamar from Agrarna skupnost on November 15, 1936, and arranged it for the needs of mountaineers.
CURRENT conditions in Tamar: there is still a lot of snow in Tamar, 80 centimeters at Dom v Tamarju. Therefore, full winter equipment is still required, set out on tours early enough, check weather and snow conditions, and inform your family about your paths and plans.
